Vehicular manslaughter

Vehicular manslaughter is the act of causing the death of another person by gross negligence in a vehicle (including speeding), drunk driving, and reckless driving.  Vehicular manslaughter is also commonly known as vehicular homicide.  In cases of vehicular manslaughter, the car is considered a deadly weapon.  This understanding makes prosecuting the crime easier, and also allows for stricter punishments for offenders that take the life of other drivers not in violation of the law.  In states without statutes for vehicular manslaughter, manslaughter and murder are used as alternatives to the more specific vehicular manslaughter.   

Vehicular manslaughter is a strange crime because it can be charged as either a misdemeanor, or as a felony.  Misdemeanor vehicular manslaughter is generally charged when the death of the other individual occurred due to negligence on the part of the driver.  For example, if the driver was speeding and hit another car, causing the death of the driver of the other car.  Obviously this act was not malicious in nature, but because the individual was reckless and negligent in their driving, another individual was killed.  In contrast, a felony case of vehicular manslaughter can be waged against an individual who kills another person due to intoxication (DUI).
