Rape is defined as a nonconsensual and/or forced sexual contact by one party against another party. Thus, individuals who are under the influence of a legal or illegal substance (whether taken by will or drugged), is underage, asleep, passed out, or mentally impaired, cannot be considered to have consented. Thus, sexual acts with the aforementioned individuals is considered rape.
