Rape is defined as a nonconsensual and/or forced sexual contact by one party against another party.  Rape also includes sexual contact that is engaged in under threat of harm, even if physical harm hasn’t occurred, threatened harm is enough to constitute rape.  In general, to constitute as rape, an act has to include the penetration of an orifice by an object.  This can include any orifice by any object, thus sodomy is also included as rape.  Secondly, a charge of rape must include force and/or the threat of force.  An individual cannot claim rape after a sexual encounter if the sex was consensual at the time, and later there is regret.  The sexual contact must occur under the threat of force, or of actual force.    Lastly, the sexual contact must be initiated against the will of the victim.  Again, a person cannot claim rape unless the sexual act is forced upon them, and there is no consent to the act.  This also means that those who are unable to consent cannot be considered to have done so.  Thus, individuals who are under the influence of a legal or illegal substance (whether taken by will or drugged), is underage, asleep, passed out, or mentally impaired, cannot be considered to have consented.  Thus, sexual acts with the aforementioned individuals is considered rape.
